These Terms of Service ("Terms") govern your access to and use of the Purist Labs website located at peptides.puristhealth.org (the "Site") and the purchase of research peptide products ("Products") from Purist Labs ("Purist Labs," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.
1. Eligibility and Provider Requirements
Access to Purist Labs products is restricted exclusively to licensed healthcare professionals and qualified research organizations. By using this Site or placing an order, you represent and warrant that:
- You hold all required professional licenses, registrations, and certifications under applicable federal, state, and local law.
- You are authorized to purchase Research Use Only ("RUO") products for lawful research purposes.
- You will comply with all applicable laws and regulations, including FDA, DEA, and state medical and pharmacy board requirements.
- You accept full responsibility for compliance in your state or jurisdiction of practice.
2. Research Use Only
All products sold by Purist Labs are sold exclusively for in-vitro laboratory research use, analytical use, and related scientific purposes. Products are not intended for use in humans or animals, including but not limited to diagnosis, cure, mitigation, treatment, or prevention of disease. All products are labeled and sold strictly as Research Use Only ("RUO").
Purist Labs expressly disclaims any and all warranties, expressed or implied, including any warranty of merchantability, fitness for human or veterinary use, or fitness for a particular clinical purpose.
3. Prohibited Activities
You agree that you will not:
- Sell, distribute, or transfer products to unauthorized third parties.
- Market products for human or animal consumption or represent them as safe or as alternatives to FDA-approved products.
- Alter labeling or documentation associated with any product.
- Use products in violation of applicable federal, state, or local law.
- Make any therapeutic, diagnostic, or clinical claims about products distributed by Purist Labs.
4. Account Registration and Verification
To access products, you must provide accurate and complete information during registration. Purist Labs reserves the right to verify credentials and refuse or cancel orders at its sole discretion. Provider status is subject to periodic re-verification.
5. Orders, Payment, and Shipping
All orders are subject to pricing, payment, and fulfillment terms in effect at the time of order. Products are shipped in accordance with industry standards for research materials. Risk of loss passes to the provider upon delivery. You are responsible for proper storage, handling, and lawful disposal of all products in accordance with applicable regulations.
6. Limitation of Liability
To the maximum extent permitted by law, Purist Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the sale or use of Products. Purist Labs' total aggregate liability for any claim shall not exceed the amount paid by the provider for the specific product giving rise to the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Purist Labs and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of your purchase, handling, storage, use, or disposal of Products, or your violation of these Terms or applicable law.
8. Intellectual Property
All content on the Site, including text, graphics, logos, and product descriptions, is the property of Purist Labs or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, and you consent to such jurisdiction.
10. Modifications
Purist Labs reserves the right to update these Terms at any time. Continued use of the Site or purchase of products following any modification constitutes acceptance of the revised Terms. The effective date at the top of this page reflects the most recent revision.
